Terms & Conditions

Last updated: 8 October 2026

These Terms are an agreement between you and On Point Holdings Pty Ltd (ACN 618 965 807) ("Checked In", "we", "us", "our"), which operates the Checked In app, website and related services, including The Guide, Where To, Postcards, Right Now / Noticeboard, The Lounge, Directory and Playlists (the "Services"). Checked In runs on the Me Business platform, which we also operate.

Please read these Terms carefully. They include limits on our liability (section 17) and your responsibilities when meeting other travellers (section 9). Nothing in these Terms removes rights you have under the Australian Consumer Law or other consumer laws that can't be excluded.

1. Accepting these Terms

1.1 You accept these Terms when you create an account and tick to agree, or otherwise use the Services. If you don't agree, please don't use the Services.

1.2 Our Privacy Policy explains how we handle your personal information. Our Community Guidelines form part of these Terms.

1.3 We may update these Terms to reflect changes to the Services, our business or the law. If a change is material, we will give you at least 14 days' notice in the app or by email before it takes effect, unless the change is required sooner by law or to address a safety or security risk. If you don't agree with a change, you can close your account before it takes effect. If you keep using the Services after that, the updated Terms apply.

2. Eligibility and your account

2.1 You must be at least 18 years old to use the Services.

2.2 You must give accurate information, keep your login details secure, and tell us promptly if you think your account has been misused. You are responsible for activity on your account.

2.3 You may not impersonate anyone, create an account for someone else, sell or transfer your account, or create a new account after we have closed one for breaching these Terms.

3. The Services are free

3.1 The Services are currently free to use. We earn money from clearly labelled sponsored placements, Directory listings and, where disclosed, affiliate commissions.

3.2 If we introduce paid features, we will show the price and any additional terms before you buy. Purchases made through the Apple App Store or Google Play are subject to their payment, renewal and refund terms.

4. Permissions

4.1 Some features need access to your device, such as location (check-ins, nearby and presence features), camera and photos (posting), microphone and camera (audio and video calls), and notifications. We will ask for permission before accessing these, and you can change your choices in your device settings at any time.

4.2 If you refuse or withdraw a permission, the related features won't work, but you can still browse The Guide, Postcards and the Directory.

4.3 We will only send you marketing messages if you opt in. You can unsubscribe at any time. We will still send essential messages about your account, security and changes to these Terms.

5. Check-ins, location and presence

5.1 A check-in is something you choose to do. We don't publish your location unless you check in publicly or post content tagged to a place.

5.2 Presence counts (such as "12 travellers nearby this week") are aggregated and de-identified. We are introducing a minimum threshold of 3 people and approximate rather than exact distances. Private check-ins may count toward these aggregates but never show your identity.

5.3 You can set visibility to public, community-only or private, and view or delete your location and check-in history, in Settings.

5.4 You must not use the Services, including check-ins, presence counts, posts or messages, to locate, track, follow, monitor or contact anyone against their wishes. Doing so will result in your account being closed and may be reported to police.

5.5 Location data may be inaccurate. Don't rely on it for navigation, safety or emergencies.

6. Messaging, audio and video calls

6.1 Where available, the Services let you message and call other users. Use them respectfully and in line with the Community Guidelines.

6.2 You must not record, screenshot for distribution, livestream or share another person's call, video or private messages without their consent. Recording without consent may be a crime where you or the other person are located.

6.3 You must not use calls or messages to harass, threaten, scam, send unsolicited sexual content, solicit money, or advertise without our permission.

6.4 Checked In is not a phone service and cannot be used to call emergency services. In an emergency, use your phone's emergency number (000 in Australia, 112 in the EU, 911 in the US).

6.5 Call quality depends on your device and network. We don't guarantee that calls or messages will connect or be delivered.

6.6 You can report any user by emailing info@checkedin-app.com. We are adding in-app report and block tools. Private messages are end-to-end encrypted, so we can't see them unless you or another participant chooses to share them with us in a report. We may review call and message metadata (not content) when investigating a report.

7. Your content

7.1 "User Content" means anything you post or send through the Services, including recommendations, reviews, ratings, photos, Noticeboard posts, Lounge posts and messages, and check-in notes.

7.2 You own your User Content. To run and promote the Services, you give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for example crop, resize, translate or excerpt) and distribute your public User Content in the Services and in Checked In's marketing, with credit to your username where practical. We may let our service providers use it only to help us do this. The licence ends when you delete the content or your account, except for copies already shared or in backups for a limited period, and content others have already reshared within the Services.

7.3 You consent to us doing anything with your User Content allowed by this licence that might otherwise infringe your moral rights, such as cropping or not attributing it where that isn't practical.

7.4 You promise that you have the rights to everything you post, that it is accurate to the best of your knowledge, and that it doesn't infringe anyone's copyright, privacy or other rights or break any law.

7.5 You must not post: spam; fake, paid or incentivised reviews; content about your own business without disclosing your connection; hateful, harassing, defamatory, sexually explicit or illegal content; other people's personal information; content that encourages dangerous or illegal activity; or content you don't have rights to use.

7.6 Venue owners, staff and operators must clearly disclose their connection when posting about their own business, and may not review it.

8. Moderation, reports and complaints

8.1 We have zero tolerance for objectionable content and abusive users. You can report content or users by emailing info@checkedin-app.com, and we are adding in-app report and block tools.

8.2 We review reported content and may review public content. Decisions to remove content or restrict, suspend or close accounts are made by people, not automated tools. We may remove or restrict content, limit features or suspend accounts.

8.3 When we remove your content or restrict your account, we will tell you why, unless the law prevents it or it would create a safety risk. You can ask us to review the decision by emailing support@checkedin-app.com. Where practical, someone other than the person who made the original decision will review it.

8.4 To report content you think is defamatory, infringes your copyright or other rights, or is illegal, email info@checkedin-app.com with: the link to the content, why you think it's unlawful, your name and contact details, and a statement that your report is accurate and made in good faith. We will review reports promptly and act where appropriate. Australian users may also contact the eSafety Commissioner (esafety.gov.au).

8.5 We are not required to monitor all content and can't guarantee that all content on the Services follows these Terms.

9. Meeting other travellers

9.1 The Services can help you connect with other travellers and locals. We do not conduct background checks or verify the identity, intentions or claims of users. You are responsible for your own interactions with other users.

9.2 Take sensible precautions: meet in public places, tell someone you trust where you are going, don't share financial information or send money, arrange your own transport, and leave if you feel unsafe. See our Safety Tips.

9.3 If someone threatens your safety, contact local police. Please also report them to us.

9.4 To the extent permitted by law, we are not responsible for the conduct of any user, on or off the Services, or for any loss or harm arising from meeting or dealing with other users. This doesn't limit any liability we have for our own negligence or breach of law.

9.5 Checked In does not organise, host, supervise or endorse meet-ups or arrangements users make with each other, whether made through public posts, The Lounge or private messages. Private messages are end-to-end encrypted, so we cannot see or monitor these arrangements.

9.6 If you tell us about a user who has threatened or harmed someone, we will review the report and may suspend or close their account and, where appropriate, contact police.

10. The Guide, sponsored content and affiliates

10.1 Editorial picks in The Guide and Postcards are chosen independently. Businesses cannot pay to be included or to change an editorial review.

10.2 Sponsored placements and paid Directory listings are always labelled "Sponsored" or similarly, and are kept separate from editorial picks. Sponsored content is limited in each feed so editorial content always dominates.

10.3 Some links are affiliate links. We may earn a commission if you buy through them, at no extra cost to you. Affiliate links are disclosed and don't affect editorial picks.

10.4 No unauthorised advertising. You must not advertise, promote or sell products or services, post affiliate or referral links for commercial gain, or solicit users for business purposes anywhere in the Services, including recommendations, the Noticeboard, The Lounge, your profile and private messages, without our prior written consent. Businesses that want to reach Checked In users can buy a labelled placement from us. We may remove unauthorised advertising without notice, and may suspend or permanently remove accounts that post it.

11. The Directory and other third parties

11.1 The Directory and the Services list and link to independent businesses (such as tour operators, car rental, insurance, eSIMs, luggage storage, venues and booking sites) and services such as Apple Music and Spotify.

11.2 We are not a party to any booking, purchase or agreement between you and a third party. Their terms, prices, cancellation and refund policies apply, and any dispute is between you and them. We don't guarantee their quality, safety, licensing or availability, though we will act on credible complaints about listed businesses.

12. Travel information disclaimer

12.1 Content in the Services, including The Guide, Postcards, Right Now posts, user recommendations and Directory listings, is general information only. It is not professional travel, safety, health, medical, visa, immigration, insurance, financial or legal advice.

12.2 Opening hours, prices, safety conditions and availability change. Always check details with the venue or operator, read official government travel advice (such as Smartraveller), and arrange suitable travel insurance, visas and vaccinations.

12.3 You are responsible for deciding whether a destination, venue, activity or operator is safe and suitable for you, and for following local laws.

12.4 Automatic translations may not be accurate.

13. Acceptable use

You must not: break any law (including local laws where you travel); scrape, crawl or collect data or content from the Services by automated means without our written permission; use the Services or content to train AI models without our written permission; access accounts or systems without authorisation, or upload malware; interfere with or overload the Services; reverse engineer the app except as permitted by law; create fake accounts or manipulate ratings or counts; use the Services while driving or in a way that puts you or others at risk; or collect other users' personal or location information.

14. Our intellectual property

14.1 The Services and our content, including text, editorial guides, Postcards, images, logos, design, software and code, are owned by or licensed to us and protected by copyright and trade mark laws.

14.2 We give you a personal, non-exclusive, non-transferable, revocable licence to use the app and view our content for your personal, non-commercial use, in line with these Terms. You may not copy, republish or commercially use our content without our written permission.

14.3 If you send us feedback or ideas, we may use them without obligation to you.

14.4 To report copyright infringement, see section 8.4.

15. Changes to the Services

We may change, add or remove features to improve the Services, for legal, security or technical reasons, or for business reasons. Where a change significantly reduces what you can do, we will try to give you reasonable notice. We aim for the Services to be available, but they may sometimes be interrupted for maintenance, upgrades or reasons outside our control.

16. Suspension and termination

16.1 You can stop using the Services and delete your account at any time in Settings.

16.2 We may suspend or close your account, or restrict features, if we reasonably believe you have breached these Terms or the law, created risk or harm for other users or us, or if we are required to by law. Unless it would create a safety, security or legal risk, we will tell you why and give you a chance to respond.

16.3 We may stop providing the Services altogether with at least 30 days' notice, and will give you a way to download your data.

16.4 Sections that by their nature should continue (including 7.2 for content already shared, 9.4, 12, 17, 18 and 20) continue after your account ends.

17. Our liability

17.1 Consumer law. Our Services may come with guarantees under the Australian Consumer Law and other consumer laws that can't be excluded. Nothing in these Terms excludes, restricts or modifies those rights. Where we're allowed to limit our liability for failing to meet a guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.

17.2 Otherwise, to the extent permitted by law, the Services are provided "as is" and "as available", and we do not guarantee that content (including user content, Directory listings and presence counts) is accurate, complete or up to date, or that the Services will be uninterrupted or error-free.

17.3 To the extent permitted by law, we are not liable for: indirect or consequential loss; loss of profits, revenue, data or opportunity; or loss caused by other users, third-party businesses, your travel decisions, or events outside our reasonable control.

17.4 To the extent permitted by law, our total liability to you for all claims connected with the Services is limited to the greater of AUD $100 or the amount you paid us (if any) in the 12 months before the claim.

17.5 Sections 17.2 to 17.4 do not limit liability for death or personal injury caused by our negligence, fraud, wilful misconduct, or any liability that cannot be limited by law. If you are an EU or UK consumer, we are also liable for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care.

18. Your responsibility to us

If you breach these Terms, the law or someone else's rights, including through content you post, you are responsible for loss or costs (including reasonable legal costs) that we reasonably incur as a result, except to the extent the loss was caused by us. This applies to the extent permitted by law.

19. App stores

19.1 If you downloaded the app from the Apple App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for any product warranty or for handling claims relating to the app (including product liability claims, failure to meet legal or regulatory requirements, and consumer protection claims), and is not responsible for investigating or defending third-party intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.

19.2 If you downloaded the app from Google Play, the Google Play Terms of Service also apply.

20. General

20.1 Governing law. These Terms are governed by the laws of Victoria, Australia. You and we agree to the non-exclusive jurisdiction of the courts of Victoria. If you are a consumer living in the EU, UK or elsewhere, you also keep the protection of mandatory consumer laws where you live and may bring claims in your local courts.

20.2 Disputes. Please contact us first so we can try to resolve any issue informally within 30 days.

20.3 If any part of these Terms is unenforceable, it will be read down or severed and the rest continues. If we don't enforce a right straight away, we haven't waived it.

20.4 We may transfer our rights and obligations under these Terms to a successor in a business sale or restructure, provided your rights aren't reduced. You may not transfer yours.

20.5 These Terms, the Privacy Policy and the Community Guidelines are the entire agreement about the Services.
